"The civil code is an organic body of civil law provisions, but not only, since it also contains rules of civil procedural law of general importance (e.g. book VI - Title IV) and some incriminating rules (e.g. book V - Title XI). It constitutes, together with the establishment of the Italian Republic and the special laws one of the sources of civil law.
The civil code currently in force in Italy (approved with Royal Decree of 16 March 1942, n.262), which replaced that of 1865, is the code issued in 1942 and contains significant differences compared to the model of the French and Italian tradition of the nineteenth century. In addition to this tradition, it is also affected by the influence of another model of civil code, more recent, which has had an extraordinary importance for the evolution of Italian legal science of the first half of the twentieth century: it is the 1900 Bürgeliches Gesetzbuch.
The civil code of 1942 has a unique peculiarity of the contemporary European civil codes: it contains both the discipline of civil law and the discipline of commercial law, which previously were dictated in two different codes. "
